Hi Raoul,

No, I don’t think you have this right at all. For matters that involve gTLD policy, the changes to the contract have to go through the GNSO’s PDP first, followed by adoption by the Board and a cycle of implementation.

For matters outside of gTLD policies, negotiations take place between ICANN and the Contracted Parties, and they both have to agree to whatever changes are made. However, I do imagine that if ICANN Org wants to push through new obligations it knows would be unappealing to the Contracted Party in question, it’d probably want to have some leverage handy.
