Yes. We need something in place of point 9 they rejected.

I would want something that involves the NCA, maybe letting the NCA
nominate a few candidates at that point, possibly including
him/herself, and if those are also rejected, then maybe some other
mechanism, and ultimately ending in explicit "we failed and it's
all-out war ever after" (perhaps not phrased quite like that though).
