I hope this finds you well and that you had a great weekend. Thank you
again for the opportunity to speak with the NCSG at ICANN 60 in Abu Dhabi.
As noted below, during my time with the constituency, Ayden Férdeline asked
the following questions, starting at 2:20:03 in the session recording:
“What are the protections that are in place for registrants? I know at one
state that it was possible to submit anonymous complaints against
registrants. Is this still possible…? What are protections in place for
registrants?”
Section 9 of the 2013 Registrar Accreditation Agreement
<https://www.icann.org/resources/pages/approved-with-specs-2013-09-17-en>,
titled Registrants’ Benefits and Responsibilities, addresses registrant
rights and protections within ICANN’s remit. A synopsis of this section, as
provided in ICANN’s Summary of Safeguards under ICANN’s Remit
<https://www.icann.org/en/system/files/files/cccs-safeguards-11sep17-en.pdf>,
follows:
- Registrant is entitled to accurate and accessible information about:
- The identity of the ICANN Accredited Registrar;
- The identity of any proxy or privacy service;
- Registrar's terms and conditions and pricing information;
- Terms and conditions and pricing information for privacy;
- The customer support and privacy services offered by the Registrar;
- How to raise concerns and resolve disputes with your Registrar; and
- Instructions that explain Registrar's processes for registering,
managing, transferring, renewing, and restoring domain name
registrations,
including through any proxy or privacy services.
- Registrant shall not be subject to false advertising or deceptive
practices by a Registrar including deceptive notices, hidden fees, and any
practices that are illegal under the consumer protection law of
Registrant’s residence.
As to anonymous complaints, ICANN’s contractual compliance team does accept
such complaints, however, they relate to Registry or Registrar activity as
reflected by the Contractual Compliance 2017 Quarterly reports
<https://features.icann.org/compliance/dashboard/2017/q3/complaint-count-reporters>.
We do not have metrics reflecting any type of anonymous complaint against a
registrant and we have not been able to locate any historical policy or
practice enabling anonymous complaints against registrants.
As noted during the session, the ICANN organization is willing to
facilitate a community-wide, transparent discussion around registrant
issues. We welcome further input, questions, and specific topics for
discussion.

During our meeting <https://participate.icann.org/p2wx932gbw8/> with the
Consumer Safeguards Director in Abu Dhabi on 31 October, I asked what
protections were in place for domain name registrants. Bryan Schilling
responded, "I don’t know, I can get back to you on that." Schilling has not
communicated to me a response to this question — I was wondering if one had
been sent to NCSG, NCUC, or NPOC leadership? If so, I hope you might be
able to share the response. Thank you.
