The Task Force is tasked with making recommendations to the CCOICI following its review of the existing SOI requirements. Since then, ICANN org has devoted additional staff resources to help assist the community to understand which recommendations may result in work for each of the respective Supporting Organizations and Advisory Committees, and of particular interest to the GNSO, each of the Stakeholder Groups and Constituencies (which for the most part, are entirely separate from work the GNSO Council will undertake). The Council received a brief update on WS2 from ICANN org during its September 2021 meeting. Also the EU has published a report on DNS abuse without any consultation with civil society, considering industry and IPstakeholders only (at least thats my impression at the first glance) Even if we don?t have a position we have to meet with the CPH about this and definitely parse out which of their activities related to ICANN mission and which doesn?t. The fact that DNS abuse initiatives are forming one after another is kind of puzzling for me. I thought the abuse institute was going to gain momentum and most of the work be done there. I might be wrong. On behalf of the Council Committee for Overseeing and Implementing Continuous Improvement (CCOICI), I am pleased to share with you our report and proposed recommendations in relation to the GNSO?s Working Group Self Assessment (WGSA) requirements. You will find in the report proposed redline updates to existing provisions and documents that relate to the WGSA as well as new elements, such as a proposed periodic survey. As you may be aware, any changes to the GNSO Operating Procedures need to be published for public comment before these can take effect, however, to avoid duplication of efforts, the CCOICI recommends combining the public comment forum with any proposed changes that the Statement of Interest (SOI) Task Force (TF) may be making. As that group has just commenced its deliberations, the timing of this is not clear yet, but the CCOICI will closely follow the TF deliberations and inform the Council should this proposed approach no longer make sense (either because of timing concerns or if the TF is not planning to make any proposed changes to the GNSO Operating Procedures). Following the public comment forum, the CCOICI may need to make updates to the report, based on the input received, following which the Council will be requested to consider the report for adoption. The one thing I wanted to flag, and this was also discussed during the policy call was the proposal from the council liaison to this ODP for the council to consider using a community group to develop remaining implementation elements of the Applicant Support Program for SubPro, contrary to the final recommendation which recommended a dedicated Implementation Review Team (IRT) to be convened for this. The rationale being that some of the work that SubPro Recommended be done by an IRT may involve items that are not strictly implementation. While this is possible through a GNSO Guidance Process utilizing section 16 of the PDP Manual, which allows for additional work on recommendations prior to Board adoption, during the call, some members were reluctant to support such a path. There is a lot to report on since the last update a few weeks ago when the ICANN ODP team announced the official start to the SubPro ODP. 1. *Project Timeline*: Attached is a high level project timeline provided by the ODP Team that sets forth different milestones including Community Status Updates, ICANN meeting sessions and some internal ICANN team deliverables. We are not certain whether the Community Status Updates (in March, May and August) will be webinars or reports, but that will be finalized over the next few weeks. In addition, ICANN is planning a session at ICANN73 (more on that below), and several sessions at ICANN74. And hopefully by ICANN75 in September, the ODA will be near final to discuss. This timeline was provided in response to the Council discussion during its January meeting. 2. *Question Set 2*: We have also just received Question Set #2 from the ODP team which I have copied into a Google Doc . As per our process, I will draft a proposed response which everyone is able to see, revise, comment on, etc. Although the Question states that it is related to Applicant Support, it is actually a broader procedural question as opposed to one related to the substance of Applicant Support. In the SubPro Final Report, the recommendations state that a dedicated Implementation Review Team (separate and apart from the general SubPro IRT) should be formed to finalize a number of the elements of the Applicant Support program. The SubPro Working Group believed that it did not have the sufficient expertise to develop policy on who should qualify for Applicant Support, how the funds should be distributed, etc. Though there are some recommendations at a high level, the Working Group envisioned a specific community group with that expertise should be responsible for the requirements. For those of you that want to read that section again, it is Topic 17 (pages 71-83). The *Implementation Guidance* states: *?A dedicated Implementation Review Team should be established and charged with developing implementation elements of the Applicant Support Program. In conducting its work, the Implementation Review Team should revisit the 2011 Final Report of the Joint Applicant Support Working Group98 as well as the 2012 implementation of the Applicant Support program.?* ICANN has rightly pointed out that this is generally not the type or work that we think of being associated with an IRT and may in fact be policy. That being the case, ICANN wants to know (a) whether the Council (responsible for managing policy) is nonetheless ok will giving this work to an IRT or whether the Council wanted to create some other cross community team (called something other than an IRT) to do this work. Incidentally, I believe this question provides us with an opening, should we choose to take it, where the Council can actually commission a group to start working on these issues NOW as opposed to waiting for Board approval in 2023. In other words, the Council can always modify its policy recommendations at any time prior to the Board approving the policy recommendations. So although we technically cannot commission an IRT until the Board approves the policies, we can commission a group to work on Applicant Support issues now. If this group can complete its work prior to the Board approving the SubPro Policies, the PDP Manual would allow us to update the SubPro policies to include the group?s recommendations (if we wanted to). If, however, it does not complete the work by that time, then they would be new recommendations to the Board for approval. This is no different really at the end of the day than the outcome of an IRT. *Therefore, I would like to propose to the Council that it consider creating a group to work on these applicant support issues and solicit volunteers from the GAC and ALAC (who are VERY interested in this subject) to start work on this as soon as possible. And if this is a good model, perhaps there are other recommendations in the SubPro Report where those were referred to IRTs, but really may involve some policy aspects that we can start work on now. * I would like to use the update time during the Council meeting to discuss this point if possible. 3. *ICANN73*: When the schedule comes out shortly, you will likely see (unless anything changes) a session on Wednesday of ICANN week for the ODP team to give an update. At that meeting they will likely be presenting on the work they have done to date and on the next set of key assumptions for the program. You may recall back in 2019 I believe ICANN released its first set of assumptions which was prior to SubPro completing its work. Some of the assumptions at that time were discussed, but others could not be discussed due to the policies at the time not being final. My understanding is that this second set will be more comprehensive and much further developed. Next steps *Item 5: COUNCIL DISCUSSION - Small Team Reviewing the System for Standardized Access/Disclosure (SSAD) Operational Design Assessment / Debrief From Meeting With the ICANN Board (25 minutes)* On 25 January 2022, the Operational Design Assessment (ODA), the final output of the System for Standardized Access/ Disclosure (SSAD) to Nonpublic generic Top-Level Domain Registration Data Operational Design Phase (ODP) was published. Just prior to the publication of the ODA, the ICANN Board sent a letter to the GNSO Council, outlining some of its concerns as well as questions it hoped to receive input on from the Council. The Council agreed to establish a small team to review the ODA in detail, focusing on the following elements as identified in the assignment form : - Whether the ODA has correctly interpreted the intent of the SSAD recommendations in the proposed implementation; - Whether the ODA has overlooked any key aspects of the SSAD recommendations that should be factored in by the ICANN Board when it considers the recommendations; - Its view on the concerns identified by the ICANN Board and potential options that could be considered, either in the form of changes to the proposed implementation or the policy recommendations themselves, to address these concerns(note, these are expected to be high level suggestions at this stage); - Any other aspects that help inform the Council?s deliberations and consultation with the ICANN Board. The GNSO Council will have met with the ICANN Board on 8 March, just prior to the March Council meeting, and will have discussed the ODA and the efforts of the small team with the Board. Next steps *Item 6: COUNCIL DISCUSSION - Update on the SubPro ODP / Debrief From Meeting With the ICANN Board (20 Minutes)* On 12 September 2021 the ICANN Board directed the ICANN President and CEO to organize the resources required to begin work on the Operational Design Phase (ODP) for the GNSO?s New gTLD Subsequent Procedures Final Report and the Affirmations, Recommendations, and Implementation Guidance contained in that report. On 27 November 2021, the Council appointed Jeff Neuman to serve as its liaison to the SubPro ODP. On 20 December 2021, ICANN org announced that the SubPro ODP had formally launched, starting at the beginning of January 2022. ICANN org shared question set #2 with the GNSO Council?s liaison to ODP on 11 February 2022, who subsequently shared the questions and an update with the Council. While the question set was specifically about the topic of Applicant Support, it introduced broader procedural concerns, about whether the level of substantive work recommended by SubPro to be conducted by an IRT, would be beyond the commonly understood scope of the IRT. As with the above item, the Council will have met with the ICANN Board just prior to the March Council meeting, and will have discussed the broader question of the Council conducting additional SubPro related work concurrent with the ODP and in advance of a Board vote on the recommendations. The team agreed that as a first step, the Council should conduct outreach to interested community groups to better understand what DNS abuse related issues need to be addressed specifically via gTLD policy development. Next steps *Item 8: COUNCIL DISCUSSION - Dialogue With ICANN?s Global Domains and Strategy (GDS) Department (20 Minutes)* The GNSO Council and ICANN?s Global Domains and Strategy (GDS) team share a very important relationship. The GDS team, in coordination with the GNSO policy support staff, track and support the policy development process. Recently, especially where the PDP charters call for it specifically, GDS has appointed liaisons to PDPs to help provide background information, channel feedback and input from the Org, and to closely monitor the deliberations of the PDP. Once the Council adopts the recommendations and they are adopted by the ICANN Board, GDS is responsible for implementing the recommendations. Given this important relationship, it is helpful for the Council and GDS to regularly communicate with each other. Here, the Council will receive a high-level update on GNSO-related work being performed by GDS, as well as look ahead to work on the horizon, including the impact on resources.
