Tx you for your work and I'm glad we have an extension.
Have you had a chance to closely review /ANNEX D, WORKING GROUP
MEMBERS' MINORITY STATEMENT ON TMCH FINAL RECOMMENDATION #1/? It's
Item #10 in the Table of Contents.
It is signed by two longtime members of the NCSG: Mitch Stoltz of EFF
and Michael Karanicolas of Yale Information Society Project. They
participated actively in the RPM Working Group and for them to help
draft and sign a Minority Statement means they are deeply concerned
about the way an issue was resolved.
I note that Rebecca Tushnet is also a signatory of the Minority
Statement. She is a professor of international trademark law at
Harvard Law School and an expert in free expression and trademark
law. (We heard her name mentioned numerous time by the US Supreme
Court in the Booking.com oral argument for the arguments of her
"Tushnet Brief.")
She is an expert in intellectual property and "fair use" which
examines when IP is going too far and imposing on the rights of
others, including noncommercial speakers.
The Minority Report reflects a disagreement in the RPM Working Group
on the issue of "word marks" and "design marks" in the RPM WG. Our
members have noted some very serious implications. /DO YOU WANT TO
TALK TO THE DRAFTERS/SIGANTORIES OF THIS MINORITY STATEMENT AS YOU
PREPARED OUR COMMENTS? SHOULD NCSG BE ECHOING THEIR CONCERNS?/
