Hello Ayden & All, 

in some instances, defending the public interest through the corporation's policy process (PDP) proved insufficient, and would have required action on a larger scale. 

This seems to be one of those instances, if the referenced article is accurate. 

In addition to the PDP, perhaps ALAC, NCSG, NCUC and other entities, inside and outside ICANN, could now raise the question of the public interest, in consultation with, say, ACLU. If ICANN is beholden to industry or other  Interests, then accountability must be sought at a higher level.
