Dear NCSG members,

Our NCSG council reps based on our advice during NCSG policy committee
meeting deferred on approving the recommendations of the working groups on
protecting Red Cross names. The deferral meant that the WG recommendations
have not been approved by Council and their approval been delayed so they
are more or less shall we say upset. We have our reasons for this deferral
which we will provide during the meeting with them (info for attending the
meeting below). But I have attached materials to this email as well as some
bullet points as to why we deferred.

If they convince us during the meeting that our concerns will be alleviated
or are baseless, then we can just ask our council reps to approve them.
But if we are convinced that we are right, after this meeting then we can
come up with a solution with  our council members, which might be to
abstain at the council and provide a statement.

1. The answers provided to our public comment were not convincing, not well
elaborated and defensive. Any rejection of comment and non action has to be
taken seriously with evidence and justification. Public comments are an
important part of the process and ignoring those comments that disagree
with the recommendations set a bad precedent.

2. The recommendations set a bad precedent regarding two aspects: 1.
allowing *additions* to a finite list to happen without going through
another PDP 2. More or less referencing that there are legal basis for such
protections. Which is not correct. Page 26 of the recommendations says:

>  "These sections summarize the Reconvened WG’s deliberations on what can
> constitute an appropriate legal basis upon which to grant *permanent
> protection *in the form of reservations for the names of the various Red
> Cross National Societies, the International Committee of the Red Cross and
> the International Federation of Red Cross and Red Crescent Societies. *The
> text herein does not purport to constitute legal analysis of the applicable
> international and national laws and should not be referenced in that
> regard. This working group has only relied on Red Cross justification that
> there are legal basis to protect these names by referencing .*

I believe they should just delete the legal basis part. Why say there are
legal basis for this action while there are not.
