Joan, your position is untenable.
PIR’s statement makes their intent quite clear. It says NCUC’s leadership was authorized to “use the funds as it saw fit. The same will be true for 2018… If NCUC leadership can administer this year’s support to the benefit of members of either NCUC or NPOC, so much the better.”
From this, it is indisputably clear that NCUC’s EC is authorized to make decisions. It is also clear that NCUC has made a good faith pledge to include all NCSG members as eligible, which PIR thinks is good. I don’t see what is wrong with that.
One of the reasons the current arrangement has the support of PIR is that it wants to make sure its donation is used in a way that advances noncommercial interests in ICANN and is not just subsidizing people who are interested in the money. We have an impeccable 10 year record of responsible management. As soon as the NCSG develops the infrastructure to do that, I as Treasurer will gladly relinquish responsibility for future PIR donations.

Yes, that was agreed that NCUC would receive the funds, however the decisions are that of NSCG, not NCUC. My proposal still stands.

The PIR funding will ultimately has to be allocated by NCSG hopefully by 2019. When NCSG will have a bank account, tax ID and NCSG Finance Committee will be operational and procedures to function based on them will be drawn, then we start allocating at NCSG FC level. It will not go to any constituency, will be allocated based on Finance Committee procedures (which NPOC has appointed a member to). That is the next year plan. I also draw your attention to this very sentence:

As previously noted, Public Interest Registry would prefer to offer its financial support to the Non-Commercial Stakeholder Group (NCSG), and let the NCSG’s leadership use it as it sees fit. Given the NCSG’s lack of infrastructure (bank account, tax ID number), however, we will continue to engage directly with the NCUC via the existing arrangements.
Finally, Public Interest Registry is open to directly supporting NPOC or NCUC ad hoc projects that meet our collective interests and needs. We make no promises of support, however, and will need to review any such opportunities on a case by case basis.
For this year, the money will go to NCUC bank account. NCUC EC will decide to open the call for travel support or other opportunities to the NCSG members and its constituencies and decide on travel allocation. NCSG will make an effort to open a bank account, get a Tax ID and come up with the appropriate procedure to allocate the funding for next year and also activate its Finance Committee.

There appears to be much bias in this decision. NCSG, NPOC and its respective representatives would have good grounds for an ombudsman referral on any decision made in this way. Please clarify.

Please note, receiving funds on behalf of the constituency does not give NCUC the right to make the decision of allocation, only to receive them. The funds have allocated for NCSG, which consist of NPOC and NCUC. PIR's intention is to do 'block funding' at the stakeholder level to benefit both constituencies equally.
A proposal for a way forward:
NPOC has its own bank account and therefore can receive and administer its own funds. I am proposing that the funds are divided equally, managed by each Constituency ECs with oversight/reporting by NCSG to fulfill any reporting requirements for the funder. I believe this is a fair, equitable and respectful way to move forward that shows good faith, building capacity for the NCSG community, while honouring PIR's 'block funding' intent.

The arrangement is that NCUC EC will decide on the allocation this year as well until NCSG FC is functional. So decisions will be solely made by NCUC EC but they have opened the allocation of funds to all NCSG members so every ncsg member can apply. After this year when NCSG has a bank account and a functional finance committee we will be making decisions at NCSG level.
