Please accept the attached as my application for travel support to<br>
attend the INTA annual meeting.<br>

I believe I am well qualified to represent NCSG interests. I have been<br>
one of a relatively small number of active and vocal non-commercial<br>
participants in the RPM working group, initially through calling for<br>
greater transparency in the Trademark Clearinghouse database and<br>
subsequently through advocacy in favour of considering the causes<br>
underlying low defence and appeal rates against complaints by mark<br>
holders (with a focus on whether registrants are sufficiently aware of<br>
the options available to them). I am also the Rapporteur for the<br>
Transparency subgroup and the Co-Chair of the Cross Community Working<br>
Party on Human Rights, both of which are relevant to NCSG’s advocacy<br>
goals in the IP field. Transparency is important in overcoming secrecy<br>
in the trademark clearinghouse database, and human rights are<br>
important insofar as it is vital to ensure that freedom of expression<br>
impacts are considered as part of the RPM review process.<br>
<br>
In terms of strategies for the conference, over the past few months I<br>
have worked closely with Kathy Kleiman, a leading non-commercial voice<br>
on trademark and IP, on a variety of projects related to IP issues at<br>
ICANN. I understand that Kathy is applying for the other slot and,<br>
assuming that we are both selected, we hope to use this opportunity to<br>
engage with academics active on these issues, as well as IP law firms<br>
that are in attendance, to bring them into the ICANN ecosystem, and to<br>
develop advocacy and programming in support of our mutual goals.<br>
Indeed, the biggest challenge that we face in the RPM working group is<br>
a shortage of active non-commercial voices. The recent addition of<br>
Jeremy Malcolm and Rebecca Tushnet have provided a substantial boost<br>
in this regard. If we could expand participation further, through<br>
contacts made at the INTA, it would provide invaluable support to our<br>
work in advancing the non-commercial perspective.<br>
<br>
In terms of my background and experience, I have a law degree with a<br>
specialized focus on freedom of expression, media and digital rights<br>
issues, and have published specifically on the subject of adapting<br>
intellectual property rules to suit the digital age. I would be happy<br>
to draft a report after the event, and indeed I already have several<br>
ideas for good areas of discussion. I am also based in Canada, and so<br>
am eligible to receive the travel support.<br>
